Terms and conditions for the Trustpilot competition
1. Organizer
The competition organizer is mybacs Vertriebs GmbH, Infanteriestraße 11a, giveaways@mybacs.com (hereinafter referred to as the "Organizer" ). The competition has no connection with Trustpilot and is neither sponsored, supported, nor organized by Trustpilot.
2. Eligibility
2.1 Only natural persons who are at least 18 years old and resident in Germany or Austria are eligible to participate.
2.2 Employees of the organizer and their relatives within the meaning of Section 15 AO are excluded from participation.
2.3 Participation in the competition is voluntary and free of charge. The purchase of products or services from the organizer does not affect the chances of winning.
3. Conditions of participation
3.1 Participation is by submitting an authentic Trustpilot review for the Promoter during the competition period. The review must comply with Trustpilot's guidelines.
3.2 Each person may only participate once per competition period. Multiple entries using different email addresses or accounts are not permitted.
3.3 Fake or automated reviews, as well as reviews that violate applicable law, morality, or Trustpilot's guidelines, are prohibited. These requirements are governed by the provisions of the German Civil Code (BGB). The organizer reserves the right to exclude participants from participation in the event of violations.
4. Prize, determination of prizes and notification
4.1 Starting from the start of the competition, one Gut Essential Duo will be raffled off once per calendar month among all participants. A total of up to twelve raffles will take place per calendar year. The prize is non-transferable and cannot be redeemed for cash (Section 762 of the German Civil Code).
4.2 The winner will be determined by random drawing. The winner will be notified by email within seven (7) days of the drawing.
4.3 If the winner does not respond within seven (7) days of notification, the prize will be forfeited and a new winner will be selected.
5. Competition period and termination of the competition
5.1 The competition is ongoing and includes monthly drawings. A total of up to twelve drawings will take place per calendar year.
5.2 The organizer reserves the right to modify, suspend or terminate the competition at any time without giving reasons, provided that this is necessary for legal or technical reasons (§ 314 BGB).
6. Data protection
6.1 The organizer collects and processes participants’ personal data exclusively on the basis of the participant’s consent and for the purpose of conducting the competition in accordance with Art. 6 (1) (a) and (b) GDPR.
6.2 The data collected will not be passed on to third parties unless this is necessary for the processing of the competition or there is a legal obligation to do so.

7. Disclaimer
7.1 The organizer assumes no liability for technical problems or data loss that are beyond its control.
7.2 The organizer is only liable for material and legal defects in the prize within the framework of the statutory provisions, in particular in accordance with Section 276 of the German Civil Code (BGB).
7.3 The organizer is not liable for damages caused by errors, delays or interruptions in transmission, malfunctions of the technical equipment or the service, unless there is intentional or grossly negligent conduct (§ 280 BGB).
8. Final provisions
8.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
8.2 Legal recourse is excluded (§ 661 BGB).
8.3 Should individual provisions of these Terms and Conditions of Participation be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.
